These Terms of Service (“Terms”) govern your use of the Fischer Panda Generators LLC website, mobile applications, and related services and processes, including our AI assistant “Ethan” (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. AI Assistant (Ethan)
Ethan provides automated responses that may not always be accurate, complete, or up to date, and the information is for general informational purposes only. Ethan does not provide professional, technical, or safety-critical advice, and you are responsible for verifying the information before relying on it. Fischer Panda Generators LLC is not responsible for decisions made based on AI-generated responses.
3. User Responsibilities
You agree not to provide false, misleading, or unlawful information; not to upload or transmit harmful, abusive, or inappropriate content; not to interfere with the security or functionality of the Services; and not to submit sensitive personal or confidential information.

12. Additional Provisions

12.3 Chat Consent
By using the chat feature, Ethan, you consent to the collection, recording, and use of information about you and the chat session by Fischer Panda Generators, LLC and any third-party providers acting on its behalf. Fischer Panda Generators, LLC may use or disclose the chat content in accordance with its Privacy Policy. If you do not consent to these terms, please do not use the chat feature, Ethan. Reach out to us by email or telephone. By continuing to interact with us via the chat feature, Ethan, you will be deemed to accept these terms.

12.9 Entire Agreement; Waiver
These Terms and posted policies set forth the entire understanding between you and us and supersede prior understandings; our failure to respond to a breach does not waive our right to act with respect to subsequent breaches.
12.10 Venue; Statute of Limitations
Claims not subject to arbitration or small-claims may be brought exclusively in the courts of Broward County, Florida.
12.10 Arbitration and Class Action Waiver [U.S. Users]
The parties agree that any controversy or claim arising out of or relating to the use of the Services shall be settled by arbitration administered by the American Arbitration Association, under the Commercial or Consumer Rules. Disputes must be arbitrated on an individual basis, and no class actions are allowed. A claim may be brought in Florida under the Small Claims Rules in place of arbitration. The Federal Arbitration Act applies; the arbitrator has authority to award only individual relief, and if the class-action waiver is found unenforceable, the arbitration provision is null and void.
By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
